BIDI VAPOR STANDS STRONGLY AGAINST YOUTH ACCESS TO THE BIDI® STICK!

Our BIDI® Stick is exclusively for adult vape users and smokers. It is not intended for adolescents and individuals under the age of 21.

Bidi Vapor opposes all illegal underage tobacco use, including ENDS use, by minors (under 21). We have taken various measures to ensure its products are not marketed toward or sold to minors.

Bidi Vapor has taken all the necessary steps to combat the rampant underage use of vapor products with its BIDI® Youth Access Prevention Measures. Aside from the tamper-resistant packaging and businesslike design, we have implemented security measures to curb underage vapers from accessing our BIDI® Sticks. From age-gating access to our website to obligating retailers to share in the responsibility of restricting youth access, we advocate for the message that no underage clients shall be able to access vape products.

Bidi Vapor is committed to fully complying with all applicable laws and regulations. We have gone above and beyond regulatory requirements to implement strict marketing restrictions and youth access prevention measures. A few of the measures Bidi Vapor and Kaival Brands have implemented to protect minors include the following:

In the Fall of 2020, Bidi Vapor prioritized compliance over business objectives by halting production of the BIDI® Stick for two months in order to revise its packaging and labeling to incorporate new product names to better align with the FDA’s Enforcement Priorities Guidance.

Bidi Vapor complies with FDA packaging and labeling requirements, including 21 C.F.R. § 1143.3 compliant nicotine addictiveness warnings placed in a prominent location on all labeling, packaging, and advertisements. The BIDI® Stick also features tamper-resistant packaging and several adult-use-only (21+) and underage sale prohibited warnings.

In February 2021, Bidi Vapor discontinued its online direct-to-consumer (“DTC”) sales of the BIDI® Stick (all flavors) through its age-restricted website (www.bidivapor.com).

Bidi Vapor took the initiative of adopting single-word, non-characterizing terms to identify its BIDI® Stick products (e.g., Classic and Arctic) to better align with the FDA’s Enforcement Priorities Guidance and further distinguish BIDI® Sticks from kid-friendly foods, drinks, and other non-ENDS products that are often marketed and/or appealing to youth.

The BIDI® Stick features tamper-resistant packaging and warnings for adult-use only (21+), and that underage sales are prohibited.

Bidi Vapor discontinued its online direct-to-consumer (DTC) sales of the BIDI® Stick (all flavors) through its age-restricted website (www.bidivapor.com) to help address the larger concerns regarding youth access to ENDS.
Online sales to adult consumers are now available only through GoPuff, which uses face-to-face ID verification and requires an adult signature on delivery.

Wholesalers and direct retailers are required to comply with the Bidi Vapor Direct Retailer and Wholesaler Agreement. Brick-and-mortar retailers must also sign a Retailer Pledge that commits them to comply with, among other things, age-verification requirements and adult-focused marketing. Direct retailers must also participate in the Company’s mystery shopper program, another technique to double-check that retailers comply with prohibitions against sales to minors.

We do not (1) use social media to market to consumers (but only maintain age-gated accounts on certain platforms such as LinkedIn, Instagram, Facebook, and YouTube for informational purposes); (2) use social media influencers, brand ambassadors, models, or actors; (3) engage in any television or radio advertising; or (4) sponsor sporting or entertainment events.

THE PACT ACT

Bidi Vapor’s partners are expected to share in the responsibility of youth access prevention. We have a signed agreement to bind them to this responsibility – the Retailer Pledge.

We discontinued our Direct-to-Consumer services and stopped selling our products online in compliance with the PACT Act. Currently, our products are being sold by GoPuff and our trusted partners and distributors who signed our Retailer and Wholesaler Agreement.

We encourage our direct retailer partners to comply with age-verification and underage sales restrictions through our agreement.

The Retailer Pledge serves as a contract to ensure that our authorized resellers observe high-quality monitoring, assessments, and commitment not to engage non-smokers and underage youth with any vape products. 

Mystery Shoppers

Mystery Shoppers are sent to retail stores to ensure that retailers strictly comply with the stringent age-verification measures.

Parental Guidance and Education

At Bidi Vapor, we pride ourselves in our consistent and strong efforts to prevent the possession and access of electronic cigarettes by minors. To aid our efforts, we strongly encourage close parental guidance and effective education to the underaged population. We believe this is vital to prevent the use of e-cigarettes of minors.

As a parent, it is imperative to determine the signs of whether your child may be using electronic cigarettes or not. Moreover, to effectively educate your children, it’s crucial that you are educated about the different varieties of electronic cigarettes and the e-liquids contained within them. Ensure you make time to talk to your child about the adverse effects and consequences of nicotine usage. This is an opportunity for you to impart awareness to your children firsthand on the potential dangers of nicotine use.

For those kids who might still be tempted to shop nicotine products, we encourage you to store your ATM cards, credit cards, and identification cards safely to lessen possible access for your kids.

  • An age gate pop-up box appears on the site to prevent underage access.
  • Bidi Vapor does not post images that can attract young individuals and ensures campaigns are targeted at an adult audience.
  • Bidi Vapor regularly review its online content to ensure it remains unappealing to the youth.

In Stores

  • Bidi Vapor created a Wholesaler & Direct Retailer Agreement containing the terms on purchasing and reselling the BIDI® Stick for all Bidi Vapor direct retailer partners.
  • Based on the terms, direct retailers must uphold the age verification process in their stores and commit to checking the customer’s identification before any transaction.
  • Direct retailers can also put the transaction on hold when in doubt or until the customer’s age is verified.
  • Mystery Shoppers will be sent to direct retailer shops to check on their compliance. Failure to comply will lead to the cancellation of orders and distribution rights.
  • Customers can only purchase 30 BIDI® Sticks per month and four (4) BIDI® Sticks per day per customer account.
