Understand what it means to have a regulatory-compliant vaping product in the market.

State law stipulates the marketing of tobacco products, including vape products, as a matter of public health.

The U.S. Food and Drug Administration (FDA) regulates the marketing of tobacco products through the  Premarket Tobacco Application (PMTA), a comprehensive process of checking every nook and corner. Only when approved do companies can market tobacco products.

The FDA’s recently implemented tobacco and nicotine regulation plan focuses on the nicotine appeal and public health issues. This serves as a guide for the tobacco industry to promote its products responsibly with consumers’ health and welfare in mind.

Proper Product Labeling Prevents Youth Vaping

Responsible promotion of tobacco and vape products means not selling to individuals below 21 years old, as provided by law. A recent study shows that vaping products have gained popularity among minors.

According to another study, teenagers have an interest in vaping products simply due to attractive fruit flavor packaging. The appeal is largely due to marketing campaigns that are aimed at attracting the youth. To prevent this, the FDA’s packaging and labeling requirements have mandated the following: 

Proper label with a visible warning sign 

The  FDA requires vape manufacturers to place a proper warning on the label to indicate the addictive and harmful properties. The font needs to be at least 12 points in size and printed in capitalized, centered, and punctuated based on the guidelines. Also, the font type should be in Helvetica bold, Arial bold, or other similar fonts. Lastly, the display panels should be around 30 percent to ensure its visibility underneath the plastic wrapping.

No use of attractive elements on the packaging

Vaping products with attractive packaging (like food, candy, cartoons, and fruity images) impact consumers’ perspectives. Teenagers start their interest in using these products because they associate the images with their youthful preferences.
